If I have caused an accident here in Delaware, will my car insurance company pay for my medical expenses?

Since the State of Delaware observes the no-fault act, then yes, your medical expenses will be covered by your car insurance company if you cause an accident. This means that you should have the minimum no-fault insurance or Personal Injury Protection (PIP) of fifteen thousand dollars that pays for medical care and rehabilitation for one person, or up to thirty thousand dollars for medical care for all persons in the car. Also included is an amount up to five thousand for funeral expenses. PIP also provides you and the other passengers with financial assistance due to lost wages.

However, a policyholder will be denied of no-fault insurance benefits if found to be driving under the influence of alcohol or any other controlled substance that contributed to the accident. Also, if he or she is found to have intentionally caused the injuries, then he or she will definitely be denied car insurance coverage. Riding or operating an all terrain vehicle (ATV) or a motorcycle is another reason for denial of benefits. However, a pedestrian struck by an ATV or motorcycle is covered. Policyholders who were injured in a car accident while committing a felony will also be ineligible for financial assistance. Likewise, driving a stolen vehicle will merit negative points and will surely be denied no-fault insurance by the company.
